I'm growing salvia in this state and from everything I've found it's still legal and there aren't any current threats to it.  I've also heard of some shops around here selling it, but I haven't actually seen that with my own eyes.

the house just passed SB 1098 making all salvia divinorum products and plants illegal to posses sale or cultivate along with synthetic marijuana. We need to call governor malloy and tell him to veto it, he is a supporter of marijuana decrim so he may veto this law the number is (860) 566-4840 call them and tell them you urge the governor to veto this bill and give reasons why....

Such as

Salvia's medicinal value
It has been used in mexico for hundreds if not thousands of years safely
you can't become addicted
you can't overdose

Come up with your own reasons too

The governor signed the bill, per:

Apparently the scheduling still hasn't been done. This bill is to give the Commissioner of Consumer Protection the ability and obligation to schedule these substances. I may write the commissioner to ask him to "please" assign the lowest possible scheduling for "plain leaves", which I consider to be very safe to use at almost any dose, providing that the user is not planning on operating heavy machinery, driving, riding a bicycle, etc, or otherwise placing his body in danger during the experience. There are some social dangers, because the altered state is a strange-seeming one to be in, and may not appropriate for work, school, or social environments, but that is another issue.

I wonder when the commissioner will actually do the scheduling. A ruling to change the wording of the law with many months and no changes made, seems strange.
